--Applicant Versus State Of Uttarakhand

--Respondent

Hon'ble Rakesh Thapliyal, J.

Mr. Mohd. Safdar, learned counsel for the applicant.

2. Ms. Sweta Badola Dobhal, learned Brief Holder for the State.

3. Present applicant-Pankaj, S/o Soshan Nath is praying for bail in reference to Range Case No.01 of 2026-27 wherein the applicant is implicated for the offences punishable under Section 2, 9, 39, 50 and 51 of Wildlife Protection Act, P.S. Forest Department Haridwar, District Haridwar.

4. It is argued by learned counsel for the applicant that applicant is innocent and has been falsely implicated; he has no criminal antecedents and is languishing in jail since 05.05.2026 and charge sheet has already been filed. He further submits that all the offences are triable by Magistrate and the maximum sentence as provided under these penal provision is 3 to 7 years.

5. Learned Brief Holder for the State has also not disputed that the charge sheet has already been filed and all the offences are triable by the Magistrate.

6. After hearing the submissions of learned counsel for the parties and taking into consideration that the charge sheet has been filed and all the offences are triable by the Magistrate and the applicant has no criminal antecedents and is languishing in jail since 05.05.2026, this Court is of the view that applicant deserves for bail.

7. Accordingly, without expressing any opinion on the merit of the case, the bail application is allowed.

8. Let the present applicant-Pankaj be released on bail on his executing a personal bond and furnishing two reliable sureties of the like amount to the satisfaction of the court concerned.
