WPCRL/1516/2026 Deepa Kashyap --Petitioner Versus State Of Uttarakhand --Respondent Hon'ble Alok Mahra, J.

Mr. Bilal Ahmed, learned counsel for the petitioners.

Mr. Prabhat Kandpal, learned A.G.A. for the State of Uttarakhand.

2. By means of the present Criminal Writ Petition, the petitioners seek the following relief: "i. Issue a writ, order or direction in the nature of mandamus directing and commanding respondent nos. 1 and 2 to provide adequate police protection to the petitioners from respondent no. 3, who allegedly seeks to endanger the lives of the petitioners in the name of family honour, as the petitioners have solemnized their marriage against the wishes of respondent nos. 3 to 5 and other family members of petitioner no. 1."

3. It is submitted that both the petitioners are major and have solemnized their marriage on 31.05.2026. Thereafter, their marriage was registered under Rule 7(1)(g) of the Uniform Civil Code Rules, Uttarakhand, 2025, on 01.06.2026.

4. Learned counsel for the petitioners submits that the family members and relatives of petitioner no. 1 are opposed to the marriage solemnized between the petitioners and, therefore, the petitioners apprehend a threat to their life and personal liberty at the hands of the said relatives and other private persons.

5. Having considered the submissions advanced by learned counsel for the parties and in view of the law laid down by the Hon'ble Supreme Court in Lata Singh v. State of U.P. and Another, reported in (2006) 5 SCC 475, this Court is of the opinion that UKHC010134952026

2026:UHC:6605 the petitioners have made out a prima facie case for protection of their life and personal liberty guaranteed under Article 21 of the Constitution of India.

6. Accordingly, the Station House Officer, Police Station Kotwali Laksar, District Haridwar, is directed to assess the threat perception, if any, to the life and personal liberty of the petitioners. In the event any genuine threat is found to exist, adequate protection shall be provided to the petitioners strictly in accordance with law. The Station House Officer shall also summon respondent nos. 3 to 5, as well as any other person found to be interfering with or threatening the petitioners, and counsel them to maintain peace and refrain from taking the law into their own hands.

7. With the aforesaid directions, the present Criminal Writ Petition stands disposed of.
