Sahibaa Jain --Applicant Versus State Of Uttarakhand --Respondent

Hon’ble Alok Mahra, J.

Mr. Tushar Prajapati, Advocate for the applicant.

2. Mr. Pushpa Bhatt, Additional Advocate General alongwith Mr. S.C. Dumka, A.G.A. for the State.

3. Applicant seeks anticipatory bail in connection with FIR No. 109 of 2020, under Sections 420, 406 & 506 of IPC and Section 4/5 of the Prize Chits & Money Circulation Scheme (Banning) Act, 1978, registered at Police Station Vasant Vihar, District Dehradun.

4. Learned counsel for the applicant submits that the applicant has been falsely implicated in the present case. It is further contended that the applicant is suffering from chronic liver disease and liver cirrhosis and as such, due to this reason and due to some matrimonial discord, she was unable to attend the court proceedings.

5. Learned State Counsel, on the other hand, opposes the anticipatory bail application and submits that the applicant has been evading the process of law. It is pointed out that a Non-Bailable Warrant (N.B.W.) has already been issued against the applicant by the court concerned.

6. In response, learned counsel for the applicant submits that the applicant will surrender before the court concerned and avail the remedy available to her in accordance with law by moving an appropriate application before the learned Magistrate. It is further submitted that the applicant undertakes to cooperate with the proceedings and shall not seek to evade the process of law.

7. In view of the aforesaid submission made on behalf of the applicant, no further orders are required to be passed in the present anticipatory bail application. Accordingly, the anticipatory bail application stands disposed of.

(Alok Mahra J.)
