COURT’S OR JUDGE’S ORDERS D-24

HABC No. 25 of 2025 Hon’ble Ravindra Maithani, J. Hon’ble Siddhartha Sah, J. None appears for the petitioner. Mr. J.S. Virk, Deputy Advocate General for the State. Mr. Rajendra Singh Azad, Advocate for respondent no.4. It is a habeas corpus petition. The petitioner has sought the custody of her young daughter. It is admitted between the parties that in Criminal Misc. Application No. 153 of 2023, Sarfaraz and others Vs. State of Uttarakhand and another, this Court while compounding the offences has accepted the terms of agreement between the parties. According to the agreement between the parties, the custody of minor daughter of the petitioner was given to the respondent no.4 and petitioner was agreeable to that settlement. Initially, this Court made a parenting plan and permitted the petitioner to meet the child on weekends. But, it so happened that the petitioner after seeking custody of the child did not handover the child to the respondent no.4. Finally, on 07.04.2026, this Court passed an order, directing the petitioner to handover the custody of the child to the respondent no.4, before the Principal Judge, Family Court, Haridwar. Today, learned counsel for the respondent no.4 submits that the custody of the child has been received by him. The petitioner is not present today. The parties have already settled and compromised about the custody of their minor daughter. Nothing survives in this petition. It stands disposed of accordingly.
