SA No.32 of 2026

Hon’ble Siddhartha Sah, J.

Mr. Avidit Noliyal, Advocate for the appellant.

The Registry has pointed out the defect that as per Order 43 Rule 1 of CPC, the appeal from order should have been filed instead of second appeal.

After going through the relevant provisions of CPC, Mr. Avidit Noliyal, learned counsel for the appellant prays for and is permitted to withdraw the present second appeal with liberty to file appeal from order.

The present second appeal is dismissed as withdrawn with liberty as above.
