2025:UHC:11662-DB IN THE HIGH COURT OF UTTARAKHAND AT NAINITAL THE HON’BLE CHIEF JUSTICE MR. G. NARENDAR AND THE HON’BLE JUSTICE MR. SUBHASH UPADHYAY Writ Petition (S/B) No.128 of 2025 31 December, 2025

Dr. Jagdambika Prasad

-----Petitioner

Versus

Chief Personnel Officer and Others ----Respondents ---------------------------------------------------------------------- Presence:- Mr. C.D. Bahuguna, learned Senior Counsel assisted by Mr. Chandra Shekhar Dalakoti, learned counsel for the petitioner. Mr. B.S. Parihar, learned Addl. C.S.C. for the State of Uttarakhand. Mr. S.S. Lingwal, learned counsel for respondent nos.1 to 4 through V.C. ---------------------------------------------------------------------- JUDGMENT : (per Mr. G. Narendar C. J.)

Heard Mr. C.D. Bahuguna, learned Senior Counsel for the petitioner; Mr. B.S. Parihar, learned Addl. C.S.C. for the State and Mr. S.S. Lingwal, learned counsel for respondent nos.1 to 4.

2. Learned Senior Counsel would submit that the petitioner is similarly situated as the petitioner in WPSB No.350 of 2023 and connected writ petitions which came to be allowed by judgment dated 14.03.2024 delivered by Co-ordinate Bench.

3. Per contra, Shri S.S. Lingwal, learned counsel submits that the State has carried the judgment in appeal

2025:UHC:11662-DB to the Hon’ble Apex Court and the same is pending in SLP (Civil) No.7307/2025 but he fairly concedes that no interim order of stay has been granted and only the contempt proceedings alone have been stayed.

4. We have suggested that the instant petition could also be disposed of in terms of the judgment rendered in WPSB No.350 of 2023 and batch by making it subject to the final order that may be passed in the above SLP. Shri S.S. Lingwal, learned counsel would concede to the same.

5. In that view of the matter, the instant petition is also disposed of in terms of the judgment dated 14.03.2024 rendered in WPSB No.350 of 2023.

6. It is made clear that the relief granted today is subject to the final order that may be passed in the pending SLP No.7307 of 2025.

7. The Writ Petition stands ordered accordingly.

8. As a sequel thereto, the miscellaneous applications, if any pending, shall stand closed.
