No. 339/2023, as applicant has lost interest in the case and SA was dismissed in default.</p><p>In order to setting aside /recall of the order dated 15.10.2024 this MA has been brought by the applicant on 06.10.2025 i.e. after lapse of one year.</p><p>Ld counsel for the applicant submitted that Advocate engaged for the same had not informed him.</p><p>Ld counsel for the respondent bank submitted that present MA has been brought after lapse of one year and further submitted that property has been auction sold and possession of the secured assets has already been given to the auction purchaser.</p><p>I have heard Ld counsel for the parties and perused the record.</p><p>The applicant has filed this M.A. on 06.10.2025 for recalling the order dated 15.10.2023 passed in SA No. 339/2023 after lapse of one year approx.</p><p>I do not find any ground for recalling /setting aside the order dated 15.10.2024 passed in the S.A.
