Counsel for the applicant submits that vide order dated 15.03.2022 OA No.218 of 2019 was dismissed for default.</p><p>I find that vide order dated 15.03.2022 it was observed "Counsel for the applicant bank" stated that he is withdrawing the vakalatnama on the ground that he has no instruction in this case," hence, none appeared for the applicant bank and the case was dismissed for default.</p><p>I find that proper opportunity was not given to the applicant for engaging another counsel.</p><p>In view of the fact, ^ment this MA has been brought within the period of limitation.</p><p>I have considered that this OA has been brought by the applicant for recovery of public money and if it is not restored to its original position the applicant bank may be put to a loss.</p><p>In view of the fact, the MA is allowed and disposed off and O.A. No.218 of 2019 is restored to its original application.</p><p>Let file be sent to Registry for compliance.</p><p>Let OA No.218 of 2019 be listed on 11.05.2026 for further hearing.</p><p>Order be uploaded on the Tribunal's website.</p></td><td data-bbox="733 151 871 977"></td></tr></tbody></table>
