Counsel for the applicant is present. BH of Ld. Counsel for the respondent is present. Ld. Counsel for the applicant is moving MA No.45 of 2023 for restoration of the OA No.71 of 2021. It is submitted when none appeared on repeated call the case was dismissed for default It is further submitted that this MA has been brought on 21.03.2023 mainly on two grounds. It was submitted that in intervening period there was a general extension of limitation by the Hon’ble Apex Court in the suo moto case and further that after the date of knowledge the application has been filed within time. Ld. Counsel for the respondent submits that the MA has been filed with a delya. Ld. Counsel for the applicant has also submitted that the OA No.71 of 2021 has been brought by the applicant for recovery of public money and if it is not restored to its original position; the applicant bank shall be put to a loss. In view of the fact, the MA is allowed and disposed off and the OA No.71 of 2021 is restored to its original position. The applicant is directed to take steps for fresh notice upon the respondents.
