JUDGMENT

1. This Review Application has been purported to be file under Rule 5-A of the Debts Recovery Tribunal (Procedural) Rules 1993 for Review of the order dated 22.11.2023 passed by this Tribunal in MA No. 141 of 2022. F \

R.A. No.18 of 2023

2. MA No.141 of 2022 was brought by the applicant purported to be filed under Section 22 (2) (g) of the Recovery and Bankruptcy Act, 1993 for recalling the judgment and order dated 02.06.2022 passed in OA No.181 of 2018 the copy of the order passed in MA No.141 of 2022 has been enclosed with the petItIon.

3. This Review Application has been brought mainly on grounds that the limitation period was not properly explained order of through the MA and the MA was filed within the period of limitation and further without giving a fair hearing the OA was decided by this Tribunal.

4. Since I am required to examine whether the order passed in MA No. 141 of 2022 comes in the purview of review as stated in Rule 5-A of the Debts Recovery Tribunal (Procedural) Rules, 1993 .

5. 1 find that vide order dated 22.11.2023 this Tribunal has examined the facts in details for saying that proper hearing of the case was made by the Tribunal before passing order in OA No.181 of 2018; the Tribunal has given a reason for coming to a finding that the MA was barred by limitation; hence, the MA has been decided on merit by the Tribunal. The scope of review has been dealt with in Rule 5 A of The Debts Recovery Tribunal (Procedure) Rules, 1993, it reads as under.

1. Any party which considering itself aggrieved by an order made by the Tribunal on account of some mistake or error apparent on the face of the record, desires to obtain a review of the order made against him, may apply for a review of the order to the Tribunal which had made the order.

2. No application for review shall be made after the expiry of a period of (thirty days) from the date of the order and no such application shall be entertained I 4P

R.A. No.18 of 2023 unless it is accompanied by an afpdavit verifying the application.

3. Where it appears to the Tribunal that there is no su#icient ground for a review, it shall reject the application but, where the Tribunal is of opinion that the application for review should be granted, it shall grant the same:

6. In view of the fact, I find that this Review Application does not comes within the purview of the Rule 5-A to review the order passed in M.A.

7. Accordingly getting no merit review application is dismissed being devoid of any merit. File be consigned to record room.
