No.07 This Review Application has been brought by the applicant to review / recalled the order dated 13.09.2024 passed in MA No.54 of 2024 with regard to SA No.847 of 2023 title as Kuldeep Kumar Vs. GIC Housing Fiance Ltd. It is stated that the applicant had filed SA No.847 of 2023 which was dismissed on 12.03.2024 for want of non-prosecution . The applicant filed MA No.54 of 2024 on 19.04.2024 for recalling of the order dated 12.03.2024 alongwith a separate application for condonation of delay (7 days only). It is further submitted that on 13.09.2024 the case was listed of hearing on recall application and wrong impression that condonation of delay application has not been filed; the MA was dismissed. At the submission of the Ld. Counsel for the respondent”/it is submitted that infact delay condonation of application was filed and it was available on the record certified copy of the same has been filed by the applicant. It is submitted that if the MA No.54 of 2024 is not restored to its original position the applicant will not be possession to pursue the SA brought by the applicant. Ld. Counsel for the respondent-F.I. has submitted that this Review Application has been brought for recalling of the order J passed in MA No.54 of 2024 and it is no! maintaina t=>Le ' I have considered the rival submissions.
