M.A. No.21 of 2018

SL No.68

**Present:-**

<table border="1"><tr><td>Counsel for the applicant</td><td>Mr. Alind Kumar Dixit</td></tr><tr><td>Counsel for the respondent-bank</td><td>Mr. Shyam Kumar Gupta</td></tr></table>

Counsel for the respondent-bank raised objection on maintainability of the M.A. He submits that despite sufficient service, the defendants did not appeared before this tribunal to contest the O.A., hence, the same was decided as ex-parte.

Counsel for the applicant filed this M.A. to recall the ex-parte order passed by this tribunal. He submits that M.A. is well within limitation from the date of intimation.

Heard counsel for the parties.

Perusal of record reveals that, the M.A. is time barred and the applicant has failed to explain the delay occurred in filing of the M.A., therefore, the present Misc. Application moved by the applicant is dismissed being time barred.

Let the file be consigned to record.

(A.H. Khan) Presiding Officer
