It is further contended by the Review Applicant that since 2014 defendant is trying to settle the account but the Applicant Bank did not settle the account. lakhs by the panel valuer of the OA applicant. The entire amount was released on 4 instalments as follows:

Total amount is Rs. 21,99,000.00.

Out of sanction amount of Rs. 21.99 lakhs defendants paid Rs. 5.52 lakhs. Thereafter HUDCO on 25.07.2000 has filed the original application being OA No. 218 of 2000 praying for recovery of a decretal amount of Rs. 34,72,811.27.

During the proceedings of the original application the mortgaged property was sold by court through receiver and original applicant received Rs. 36 lakhs being the sale proceeds which was more than the claim amount, and Review Applicant has prayed for review of the judgment delivered on 03/04/2014.
