However, the defendant failed and neglected to abide by the terms and conditions of the facility. The Defendant did not repay the outstanding Bank's dues and overdue interests in loan Account. Inspite of repeated requests and personal contact made by applicant
Bank, the defendant failed to regularize the loan Account. Despite several requests made by applicant Bank, the defendant did not pay any attention to regularize the Account; consequently, the account(s) became irregular and was classified as NPA on 31.12.2013 (Annexure 'D' in Demand Notice at page 84 of O.A.). Applicant Bank was no other alternative compelled to issue demand notice dated 24.05.2018 upon the defendant advised to regularize the accounts as soon as possible, but the defendant did not comply with the said notice; copy of said demand notice dated 24.05.2018 is annexed and marked as Annexure 'D'. Applicant Bank submitted that their claim in the Application is within limitation.
6. The notice / summons was sent to the Defendant by the Tribunal. It is seen from the S/R on affidavit dated 26.08.2025 and its enclosures that postal service of summon has been successfully effected upon the Defendant, such has been recorded vide Ld. Register's order dated 26.08.2025. Despite service, the defendant did not appear nor filed the written statement; thus, the defendant was ordered to be proceeded *ex-parte* vide order dated 29.01.2026. Ld. Original documents have been produced by applicant Bank; the same have been verified with copies of the documents annexed with O.A. and after verification the original documents have been returned to Sri Somnath Som, Sr. Manager (Law) of Bank's Sastra Division, 09th Floor, 11, Hemanta Basu Saani, Kolkata – 700001 on 17.08.2022, such has been recorded vide Ld. Registrar's order dated 17.08.2022. The documents produced by Bank are exhibited and annexed as Exhibits A-I to A-XI.
I have heard the Ld. Advocate of the applicant Bank and perused the records.
8. Evidence-on-affidavit, filed by applicant Bank, has remained unchallenged, unrebuted and its veracity cannot be put to dispute. Applicant Bank has corroborated the averments made in the T.A./O.A. Applicant Bank has proved the sanction of CGTMSE Loan facility for a sum of Rs.12.00 lakhs vide letter of sanction dated 18.05.2011 and Rs.12.37 lakh vide letter of sanction dated 06.12.2011. Applicant Bank has proved the hypothecated movable asset – vehicle; morefully described in Schedule at page 14 and para 3A at page 7 & 8 of the original application.
9. On the point of limitation, Loan has been sanctioned on 18.05.2011 and 06.12.2011; loan documents have been executed by defendant on 30.05.2011 & 23.12.2011, and Original Application has been filed on 12.06.2018. Further, the defendant executed and delivered the Balance Confirmation Letter dated 28.11.2017 in favour of applicant Bank. As such, the original Application appears to have been filed well within the period of limitation.
10. Applicant Bank has stated that the outstanding balance in Loan Account (inclusive of accrued Interest and other charges as calculated upto 31.05.2018) for a sum of **Rs.18,55,560.40** (Rupees eighteen lacs fifty five thousand five hundred sixty and paise forty) as on 31.05.2018, which is the amount claimed by applicant Bank in the original Application, and the defendant is liable to repay the said amount to the applicant Bank with *pendente lite* and future interest, till realization in full. I allow the claim as made by the applicant Bank in the original Application. Applicant Bank has prayed future interest at the contractual rate, i.e. @ 15.10% per annum excluding penal interest of 2% above normal rate with monthly rests, till the actual payment or realization thereof; while in Demand Promissory Note dated 30.05.2011 and 23.12.2011 the rate of interest @ 13.50% per annum and @ 14.10.% per annum respectively with monthly rests, have been mentioned. Therefore, in my view, the *pendente lite* & future rate of interest @ 13.50% per annum, with quarterly rests, from 01.06.2018, is allowed.
11. The matter also falls within the territorial as well as pecuniary jurisdiction of this Tribunal. The Applicant Bank has proved its claim made in the O.A./T.A. The original application being T.A./10 of 2020 (arising out of OA/479 of 2018) deserves to be allowed; hence allowed.
