ORDER
(i) The instant M.A. has been filed by the Misc. applicant for recalling / restoration of order dated 04.05.2018 arising out of T.S.A./06 of 2014 (S.A./92 of 2010 on the file of DRT-1) to its original file by recalling of order dated 04.05.2018 on the grounds that the Ld. Advocate on record could not attend the Tribunal due to his illness and that the Ld. Advocate for respondent Bank was also not present on that day. Affidavit-in-opposition to the recalling Application has been filed by the respondent Bank opposing the said Application and prayed for dismissal of the said application.
(ii) It is a fact that the S.A. 92 of 2010 has been filed on the file of DRT-1, and subsequently the same has been transferred to this Tribunal and renumbered as T.S.A./06 of 2014. And as none appeared for the Applicant the same was dismissed. The submission made by the Misc. applicant is that an OTS proposal was under process and accordingly the matter has been adjourned for outcome of the settlement. Further, no effective steps have been taken by the Applicant either settlement or disposal of S.A. There were no bonafide grounds taken except for the personal inconvenience of the Ld. Counsel for the Misc. Applicant in not appearing before this Tribunal due to his illness.
(iii) This Tribunal is of the opinion that for the absence of Ld. Counsel, the Misc. Applicant, shall not suffer; but however, this Tribunal is of the opinion that the Applicant if keen on settlement of the loan Account shall submit a fresh concrete settlement proposal along with 20% of the upfront money of the Sec. 13(2) Notice amount within 15 days from the date of this order. Upon compliance, the respondent Bank shall consider such proposal and settle the matter in accordance with their Recovery Policy Guidelines; failure to comply the order of this Tribunal, the matter shall be heard and decided on merits. The applicant shall appraise the status of such settlement before this Tribunal by way of an Affidavit after completion of 15 days.
In the event of failure of settlement, the Misc. Applicant shall argue the matter without any further adjournment.
Accordingly, the M.A. being M.A. No.37 of 2018 arising out of TSA / 06 of 2014 is allowed and disposed of. The order in TSA No.06 of 2014 (S.A./92 of 2010 – DRT-1) is hereby restored in its original file by recalling the order dated 04.05.2018.
