PER COURT :

1.

At the outset, learned Counsel Mr. Kanakdande seeks leave to assist learned APP on behalf of the informant.

3.

In view of this, learned Counsel Mr. Kanakdande is permitted to assist learned APP on behalf of the informant.

for the offences punishable under Sections 109(1), 351(3), 352, 189(2), 191(2) of Bharatiya Nyaya Sanhita.

5.

First Information Report indicates that the incident had occurred on 16.08.2026 at about 4.45 pm in which the informant and witnesses were assaulted by the Applicant and co-accused.

There is allegation against the Applicant that she caused assault with a sickle on the hand of the informant so also other accused persons assaulted him with iron rod.

6.

Learned Counsel for the Applicant submits that the Applicant is a lady with no criminal history. It is his submission that though allegation is made against the Applicant of using sickle for causing assault, no injury is caused to any person in order to sustain said allegation. It is his contention that in view of this fact, possibility of false/over implication is not ruled out.

7.

Learned APP and learned Counsel for the informant opposed grant of any relief to the Applicant by referring to the allegations against her in the First Information Report which are supported by the injury certificates on record. Learned APP submits that for

recovery of weapon, custodial interrogation of the applicant is necessary. Learned Counsel for the informant drew attention of the Court to the document filed along with the application for intervention.

8.

Prima facie perusal of the First Information Report indicates that the present Applicant is said to have used a sickle to cause assault on the left hand of the informant. Perusal of injury certificate does not correspond the said allegation. There is no allegation against the present Applicant of causing assault on the head of the informant. Applicant is a lady. Appropriate direction to her to appear before the Investigating Officer will meet the purpose of investigation. Hence, her liberty is protected. Hence, the following order :-
