This is an application seeking stay to the execution of the impugned judgment and decree.

Perused the application. Heard the learned advocate for both the sides.

Learned advocate for the respondent strongly objected the application and submitted that rent amount as per the judgment and decree is not deposited. Considering his submission, the application deserves to be allowed partly. Hence the following order is passed:

ORDER:
i) The civil application is allowed in terms of prayer clause (B), subject to the following conditions:
(a) The applicant shall deposit 50% of the amount, with accrued interest, in the Executing Court within a month from today.
(b) If the amount is not deposited within a month in the Executing Court, the application shall be deemed to be rejected without further reference to the Court. [SANJAY A. DESHMUKH, J.]
