936-cp-464-2026 IN THE HIGH COURT OF JUDICATURE AT BOMBAY BENCH AT AURANGABAD CONT. PETITION NO. 464 OF 2026 IN WP/496/2024 Ahnednagar Education Society Ahmednagar For And On Behalf Of It Smt Chhaya Ashok Firodiya VERSUS Spy Developers Builders And Suppliers A Partner Through Its Partners Shrikant Shankar Chhindam ... Mr. A. M. Gholap, Advocate for the Petitioner Mr. S. P. Sonpawale, AGP for Respondent-State Mr. S. N. Gaikwad h/f Mr. N. V. Gaware, Advocate for Respondent nos.1 and 2 ….. CORAM : AJIT B. KADETHANKAR, J. DATED : 15TH OCTOBER, 2026 P.C. :- . The Contempt Petition is filed for the reason that the petitioner in Writ Petition No.496 of 2024 did not file the undertaking which was ordered by this Court at clause-III of the impugned order dated 17.12.2024.
2. Today, an undertaking on oath sworn by one Shripad Shankar Chindam on his own behalf and on behalf of Shrikant Shankar Chindam has been filed in compliance of Clause-III. A copy of the said undertaking is given to Mr. A. M. Gholap, learned Advocate for the petitioner. After going through the 2026:BHC-AUG:49967
936-cp-464-2026 text of the order, he expressed his satisfaction as regards to compliance of the undertaking.
3. Mr. Gholap, learned Advocate however has a small reservation that the said undertaking is not signed by both the writ petitioners/partnership firm. To this, it is explained by the other side that the undertaking is signed by one of the partners both on his behalf and on behalf of other other partner.
4. In view of the above, there is no need to proceed further with the Contempt Petition. The undertaking is taken on record and marked as ‘Annexure-X’ for the purpose of identification. The Contempt Petition is accordingly disposed of. ( AJIT B. KADETHANKAR, J. ) Rushikesh/2026
