1. The present application has been filed by the applicants seeking correction in the name of applicant No.2 which is shown as “Sumitra Eknath Giri” in the claim petition as well as in the appeal. The applicants want it to be replaced by “Subhidra Eknath Gosavi” instead of “Sumitra Eknath Giri”.
2. Learned counsel for the applicants submitted that, the First Appeal has been disposed of by way of compromise and the amount deposited by the insurance company is lying in this Court. Since the name of the applicant does not match with the other record produced by her for withdrawal of amount, applicant No.2 is not allowed to withdraw the said amount. In support of her claim that Sumitra Eknath Giri and Subhidra 2026:BHC-AUG:49845
936-CA.11740-26.odt Eknath Gosavi are one and the same person. The applicants have produced the certificate issued by the Sarpanch of Gram Panchayat Neknoor, District Beed who has certified on 22.09.2026 that, Sumitra Eknath Giri and Subhidra Eknath Gosavi are one and the same person. The photograph is attached on the said certificate issued by the Sarpanch which matches with the Aadhar Card annexed to the Civil Application No.4555 of 2026 at Exh.A which shows claim as “Subhidra Eknath Gosavi”.
3. The prayer made by the applicants is not resisted by the learned advocate appearing for the insurance company.
4. Since the photograph matches and the Sarpanch has also certified that Subhidra Eknath Gosavi and Sumitra Eknath Giri is one and the same person, Civil Application deserves to be allowed.
5. In view of the above, Civil Application is allowed in terms of prayer clause “B” and accordingly disposed of. (MANJUSHA A. DESHPANDE, J.) ... vmk/-
