DATED : 12TH OCTOBER, 2026

P.C. :-

.

First Appeal no.776 of 2018 arises out of the judgment and award dated 18.08.2007 passed by learned Civil Judge Senior Division, Kandhar in Land Acquisition Reference No.188 of 2004 and First Appeal no.1713 of 2021 arises out of the judgment and award dated 13.09.2011 passed by learned Civil Judge Senior Division, Link Court at Mukhed in Land 2026:BHC-AUG:48892

Acquisition Reference No.222 of 2004. Both the appeals are filed by the original claimants seeking enhancement in the compensation granted by the Reference Court.

2.

Learned Advocates for the respective parties fairly submit that the present First Appeals are covered by the order dated 03.08.2026 passed by this Court in bunch of First Appeals led by First Appeal No.3607 of 2017. It is submitted that this Court determined the rate of compensation at Rs.1,25,000/- per hectare for dry land. It is candidly agreed by the parties that the lands in present appeals and the cited matters are subject matter of same land acquisition proceeding.

3.

It is not in dispute that the subject matter lands of both the appeals are dry lands. In view of this, the parties pray that the appeals could be disposed of holding the appellants entitled for compensation at Rs.1,25,000/- per hectare. In view of the above, I pass following order:
