2023 (for short “BNSS”).
3.
In ABA No. 524 of 2026, interim protection was granted by this Court on 27.08.2026. The violation of conditions imposed by this Court has not been reported by learned APP. The officer is present today on whose instructions, the statement has been made.
4.
In ABA No.522 of 2026 there was no interim protection.
5.
Learned counsel for the applicant submits that considering the allegations levelled against them, the protection needs to be granted.
The allegations are not per say very serious. They are ready to co-operate with the Investigating Officer. They are stated to have been falsely implicated in the offence.
6.
Per contra, learned APP would submit that the allegations are very specific and their presence was at the relevant time. It is further submitted that investigation is yet to be completed. They are required for the custodial interrogation.
7.
Learned counsel appearing for the respondent no.2 adopts the submission of the learned APP. It is submitted that the applicants had reason to commit the offence. They are influential persons. There is a recovery of ornaments.
8.
I have considered the rival submissions of the parties. I have gone

through the First Information Report. Already the applicant in ABA 524
of 2026, is under the protective orders of this Court.
9.
Considering the overall prospects of the matter, nature of allegations and role attributed to the applicants, I am of the considered view that both of them are entitled for the protection.
10.
Both the applications are allowed by passing following order:-
ORDER
(i) In ABA No. 524 of 2026, interim relief granted earlier shall stand confirmed.
(ii) In ABA No. 522 of 2026, in the event of arrest the applicant be released on bail on identical conditions that are imposed by the coordinate bench vide order dated 05.10.2026. It is made clear that the applicant in that case shall attend the police station on Saturday and Sunday between 10.00 a.m. to 1.00 p.m. for two consecutive weeks and thereafter as and when required by the Investigating Officer.
(iii) Accordingly, both applications are allowed. ( SHAILESH P. BRAHME, J. )
