CIVIL APPELLATE JURISDICTION

WRIT PETITION NO. 4770 OF 2019

Mangesh Atmaram Patil And Ors.

… Petitioners

V/s.

Abhinav Shetkari Shikshan Mandal

And Ors.

… Respondents

Mr. Vinayak Patil a/w Mr. Ranjit Ade, Mr. Rajesh Shinde, for Petitioner.

Mr. S. H. Kankal, for Respondent No. 12 - State.

CORAM

: AMIT BORKAR, J.

DATED

: OCTOBER 19, 2026

P.C.:

1. The challenge in this Petition arises out of an Application filed by Respondent for condonation of delay of 7 years in filing change report.

2. By the impugned order, the Charity Commissioner recorded a categorical finding that there is no sufficient cause for condonation of delay. However, the Assistant Charity Commissioner was directed to decide change report on its merits.

3. Once the Charity Commissioner records a finding that no sufficient cause is made out for condonation of delay, the proceedings must come to an end.

38-WP-4770-2019.doc

4. Hence, Clause 2 of the impugned order dated 24 November 2017, directing Assistant Charity Commissioner to decide change report on its own merits, needs to be set aside.

5. Hence, impugned order, to the extent of Clause 2 thereof, is set aside.

6. Writ Petition stands disposed of. (AMIT BORKAR, J.)
