S.S.Kilaje

1. Learned counsel for the applicant submits that this application was filed when FIR was not registered against the applicant, however, as on today an FIR is registered against this applicant at Kongaon Police Station being FIR No. 544 of 2026 and therefore the applicant seeks leave to withdraw the instant application with liberty to file an appropriate application before the Sessions Court.

2. Since this Court had earlier granted an interim protection order by order dated 27.08.2026, it is directed that the applicant shall not be arrested for a period of three days from the date of uploading of this order. It is also directed that the applicant shall surrender his passport to the Investigating Agency within three days from today.

3. It is clarified that the Sessions Court is entitled to decide the application for Anticipatory Bail, if any, filed by the applicant, on its own merits and by considering allegations in the First Information Report.

4. In view of above, instant Anticipatory Bail Application is disposed of as withdrawn with liberty as prayed for. Pending Interim Application is also disposed of.
