28-wp-13896.26.doc IN THE HIGH COURT OF JUDICATURE AT BOMBAY CIVIL APPELLATE JURISDICTION WRIT PETITION NO. 13896 OF 2026 M/s. Shilpi Constructions, through its Proprietor Gaddigaiah R. Kurudimath … Petitioner Versus Indian Bank, through its Authorized Officer & Ors. … Respondents ****** Mr. Yash Bhumare i/b Mr. Prathamesh Mandlik and Ms. Harshada Shrikhande for Petitioner. None for Respondents. ****** CORAM : MANISH PITALE AND SHREERAM V. SHIRSAT, JJ. DATE : 19th OCTOBER 2026 P.C. : . The petitioner (borrower) has filed the present writ petition for limited direction to the Debts Recovery Tribunal-I, Mumbai (DRT) to hear and finally decide Securitisation Application No. 50 of 2020 filed by the petitioner, in an expeditious manner and preferably within 60 days from the date of the order of this Court.

2. Although, this petition is listed for the first time before this Court in the category of fresh matters and the respondents are not before this Court, we are of the opinion that a direction for expeditious disposal of the pending proceedings inures to the benefit of all the parties to the litigation. Hence, issuance of notice to the respondents is dispensed with.

3. Copies of the orders passed by the DRT in the pending Securitisation Application have been annexed to the writ petition. It appears that due to expedited matters being listed before the DRT, the Securitisation Application of the petitioner could not be taken up for consideration.

4. The Securitisation Application has been pending for the past 6 years. We are of the opinion that in such a situation, an endeavour should be made by the DRT to consider and dispose of the Securitisation Application filed by the petitioner, as expeditiously as possible.

5. In view of the above, the writ petition is disposed of, by directing the DRT-I, Mumbai, to consider and dispose of pending Securitisation Application No. 50 of 2020 filed by the petitioner, as expeditiously as possible and preferably on or before 31st January 2027.

6. Pending applications, if any, also stand disposed of. (SHREERAM V. SHIRSAT, J.) (MANISH PITALE, J.)
