1. Heard Mr. Toshnival, learned Advocate for Applicant and Mr. Nakhwa, learned APP for Respondent.
2. This is an Application under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 seeking Bail in connection with C.R. No.39 of 2026 registered with Bharti Vidyapeeth Police Station for offences punishable under Sections 109, 118(2) of the Bharatiya Nyaya Sanhita, 2023; Section 25(4) of the Arms Act, 1959; Sections 37(1)(3) read with Section 135 of the Maharashtra Police Act, 1951.
3. The Applicant is indicted in the present crime. Applicant is the sole accused person. The case of prosecution is that the Applicant

assaulted the injured victim initially with the glass bottle and thereafter with a scythe (dks;rk). Incident in question occurred in the bar and outside on the road in a public place. It is prima facie seen from the prosecution case itself that an altercation occurred between the Applicant and the injured victim who are friends, on account of the Applicant having been incensed due to a complaint filed by one of their common friends namely, a girl and the Applicant - Accused injured victim of instigating her to file the Complaint.
4. An altercation between the two friends escalated whereby while drinking beer in the bar, the Applicant inflicted a blow with the beer bottle on the head of the injured victim. The injured victim thereafter ran out of the bar onto the open public road where he was chased by the Applicant. And it is prima facie seen in the statement of the prosecution and also from the CCTV footage that after the Applicant ran after the injured victim, he on his way picked up the scythe which is a weapon in question from a sugarcane vendor along the road and chased the injured victim and inflicted six blows with the scythe injuring him grievously. The Applicant is 24 years old and is a graphic designer and a student whereas the injured victim is also a 20- year-old student. The Applicant being a young offender and the use of the weapon not being premeditated and planned and was picked up while chasing the injured victim, enures to the benefit of the Applicant for grant of bail.
