1. Having heard the learned Counsel for the Petitioner and the learned Counsel for the Society, we notice that as early as on 9th March, 2015, the Deputy Registrar of Cooperative Societies, Dombivali, has conferred deemed membership upon the Petitioner, in the wake of the appeal filed under Section 22(3) of the Maharashtra

919. wp(c)3533-26.docx Co-operative Societies Act, 1960 (“the Act”), admittedly, attempts of the Society to raise a challenge to the said order belatedly, after ten years did not yield any success, as when a revision was filed before the Revisional Authority, accompanied by an application for condonation of delay, the application was rejected, thus, closing the door on the Society. Thereafter, the Society has made many attempts to dislodge the membership of the Petitioner but since no way out could be found, the learned Counsel for the Society fairly and, on instructions, makes a statement that they shall abide by the order dated 9th March, 2015. We record the said statement as, in our view, the dispute must come to an end. Needless to state that we caution the Society that it shall not raise the issue of membership of the Petitioner once having accepted the order passed by the Deputy Registrar on 9th March, 2015, unless by some legal remedy and legal mechanism this order is set aside. Petition disposed of. Pending Interim Application is also disposed of. (ASHISH S. CHAVAN, J.) (BHARATI DANGRE, J.)
