1. Heard Shri. Sandip Sontakke, learned counsel for the petitioners and Ms. Shamsi Haider, learned Asst. G. P. for respondents/State.
2. The contention is that the petitioners were granted the benefit of additional increments by the respondents vide orders which are collectively annexed at Exhibit - C, page No.45. These orders were passed prior to 24th August, 2017. However, the respondents are not implementing the aforesaid orders and are not releasing the monetary benefits of such additional increments, along with consequential benefits, by fixing their pay in the 6th Pay Commission pay scale, citing the reason that the Government of Maharashtra had issued a Government Resolution dated 24th August, 2017, thereby stopping such grant of additional increments.
3. Shri. Sontakke, learned counsel for the petitioners, submits that the issue raised herein is no more res integra, as the Co-ordinate Bench of this Court, in Writ Petition No.9967 of 2021 and Writ Petition No.10947 of 2022, has held that the aforesaid Government 2026:BHC-NAG:13985-DB

Resolution dated 24th August, 2017, would apply prospectively and hence, all such individuals who have granted such additional increments cannot be denied such monetary benefits solely on the basis of the Government Resolution dated 24th August, 2017. He further submits that the petitioners were granted such additional increments prior to the issuance of the Government Resolution dated 24th August, 2017, and are denied the monetary benefits thereof on the basis of the said Government Resolution. Hence, the petitioners have approached this Court.
4. Ms. Shamsi Haider, learned Assistant Government Pleader for the respondents/State, does not dispute the aforesaid legal position.
5. In view of the above, we dispose of the present writ petition with a direction to the respondents to release the monetary benefits of the additional increments granted to the petitioners for excellent work vide orders collectively annexed at Exhibit - C, page No.45. The aforesaid benefits shall be granted within a period of three months from today. Since the petitioners are not claiming interest, all consequential benefits shall be calculated by adding the advance increments. Since some of the petitioners have superannuated, all consequential benefits post recalculation, be paid to the petitioners by refixing their pensionary benefits.
6. The present writ petition is, accordingly, disposed of. (RAJ D. WAKODE, J.) (URMILA JOSHI-PHALKE, J.) TAMBE Signed by: Mr. Ashish Tambe Designation: PA To Honourable Judge Date: 19/10/2026 10:41:57
