The Application is supported by affidavit of Mr. Sambit Nag, Senior Manager of the Applicant Bank's Madhyamgram Branch. The O.A. was flled on 04.09.2012 for recovery of Rs. 60,5g,574.09p.

During the pendency of the O.A. the defendants have paid Rs. 41,21,500/-- as a settled amount and the Applicant Bank has realized and received the setued amount and issued the 'No Due Certificate'dated 10.02.2020 and made prayer to dispose of the matter for non prosecution. No one is present for the O.A. defendants. Since this is an amicable settlement between the O.A. Applicant and the defendants no prejudice will be caused to the O.A.

366 of 2020. Accordingly their reply is dispensed with.

There is no other impediment if prayer is so allowed.

Accordingly I.A. No. 366 of 2020 along with TA No. 558 of 2015 are disposed of as withdrawn as setued amicably.

The Applicant is directed to return the original Tiue Deed to the O.A. defendants if it is not already returned within 15

days from the date of this order.

T.A. No. 558 of 2015 atong with I.A. No. 366 of 2o2o are disposed of.
