JUDGEMENT
This is an Transfer Application under Section 19 of the Recovery of Debts Due to Banks and Financial Institutions Act, 1993 initiated by the applicant against the defendants praying for issuance of Recovery Certificate to the tune of Rs.12,97,699.16 ps. together with interest, cost and other usual reliefs. The brief facts of the case as made out in the Transfer Application by the applicant bank is that the defendant had approached the appticant bank for grant of financial assistance to run his business in the name of M/s K.M.Minej- as sole proprietor. The applicant bank after examining the feasibility of the said proposal had sanctioned Cash Credit loan and Term loan in total of Rs.9 lakhs in favour of sole defendant on 18.08.2006 with certain terms and conditions, which was accepted by the defendants. To avail the above loan facility, the defendant had executed various loan documents on 23.0g.2006 in

7. favour of the applicant bank. After availing the loan, the defendant had utilized the said loan amount in his business and operated the loan account at the initial stage but subsequenfly the defendants had failed to operate the said loan account in terms of the agreement between the parties as a result of which the loan account became irregular. A sum of Rs.12,97,699.16 ps, is due against the defendant which the defendant had not paid despite repeated demands and request, Finding no other way to recover the dues of the bank, the applicant bank had filed this Original Application for the recovery of the aforesaid amount and for the issuance of Recovery Certificate against the defendant. Notices were issued to the defendant to show cause as to why the relief prayed for by the applicant bank be not granted. After rssuance of the notice, the defendants had neither appeared nor had filed their show cause reply. Consequenuy, the said defendants were set ex_ parte on 29.11.2019. The Tribunal had no other option but to hear ex_ parte against the defendants. I have heard the learned Counsel for the applicant bank and have perused the relevant documents. The defendants had not contested the case of the applicant bank. Thus, the point for determjnation in this case is (i) Whether the ctaim of the applicant bank is wtthin time ? (ii) Whether the defendants had utilized the loan facitities granted by the bank ? (iii) Whether the defendants are liable to the amount due to the applicant bank or not ? The applicant bank by oral its case. The documentary A to Annexure/Exh ibit-A/5, the applicant bank. and documentary evidence has established evidence comprises from Annexure/Exhibit- which are available in paper book fited by

8. From the perusal of the documents referred above and the certified copy of the statement of account, which is filed as Annexure/Exhibjt-A to A/5, it is established that the defendants had availed the financial facilities from the applicant bank and had withdrawn the amount through the account. The oral testimony comprises of an affidavit of Shri Biswajit Mondal, S/o. Shri Brajendra Kumar Mondal, working as Deputy [4anager of the Applicant Bank. The averments in the application and the facts stated by the witness of the applicant in hjs affidavit are unrebutted.
10. From the perusal of the Statement of Account which is Annexure/Exhibit-A/s, the total outstanding comes to Rs,12,97,699.16 ps. which the applicant bank is entiued to recover from the defendants.
11. In view of the above discussion and after considering the entire evidence-on-affidavit of the applicant bank and the documents filed by the applicant bank, I have no hesitation to hold that the applicant bank is entiued to recover a sum of Rs.12,97,699.16 ps. from the sole defendant who is liable for the same. The applicant bank shall also be entitled to pendentelite and future interest on the said amount @ 72o/o per annum with simple from the date of filing of the Transfer Application till the date of realization.
