The defendant appear in person. The R.C. proceeding has been disposed of by the Recovery Bench wherein during the proceeding account of the borrower was frozen and now after settlement when the bank is presenting the cheque issued by the borrower in favour of the bank the same is not being honored but the question is that when the order regarding freezing of the loan account has been passed by the Recovery Bench and the R.C. proceeding has also been disposed of by the Recovery Bench then M.A. should have been filed directly before the Recovery Bench and not before this Tribunal and accordingly, the M.A. is **disposed of** with liberty to the Ld. Counsel of the M.A. applicant to file the appropriate petition before the Recovery Bench and the Recovery Bench is directed to pass the order in accordance with law.
