The matter has been conducted through Virtual Court/online.
Ms. P. Chakraborty, Ld. Advocate appears on behalf of Mr. N. Chakraborty for the applicant bank.
None appears for the defendants.
Ld. Counsel for the applicant bank files the instant IA/324/2020 with the submission that the matter has been settled between the parties through compromise settlement process and the defendants have paid the entire settlement amount to the bank with no dues. Applicant Bank has issued 'No Dues Certificate' and also praying for withdrawal the matter as settled.
In the above circumstances, nothing remains to be adjudicated. The IA/324/2020 is allowed and the TOA/990/2017 is disposed as withdrawn.
Applicant bank also files a joint petition IA/325/2020 praying for refund of Court Fees.
The refund of Court Fees is allowed as per the provision of DRT (Refund of Court Fee) Rules, 2013. The applicant bank is directed to approach the Registry for scrutiny and further submission for approval.
Copy of this order be given to both the parties.
File be consigned to the Record Room.
