**Indian Overseas Bank** **Vs** **Mr. Him Kumar Gautam**
The matter has been conducted through Virtual Court/online.
Mr. P. Joarder, Ld. Advocate appears for the applicant bank.
No one has appeared for the defendants.
Ld. Counsel for the applicant bank files Instant IA/364/2020 with the submission that the matter has already been settled between the parties through compromise settlement process and the defendants have paid the entire compromise amount to the bank with no dues. Applicant bank has issued 'No Due Certificate' and also praying for withdrawal of the matter as settled.
In the above circumstances, nothing remains to be adjudicated.
IA/364/2020 is allowed and the TOA/127/2017 is disposed of as withdrawn.
Applicant bank also files an IA/365/2020 praying for refund of Court Fees.
The refund of Court Fees is allowed as per the provision of DRT (Refund of Court Fee) Rules, 2013. The applicant bank is directed to approach the Registry for scrutiny and further submission for approval.
Copy of this order be given to both the parties.
