Mr. Veeran Baswa, applicant had lodged the matter vide diary No. 699 of 2025 for Misc. Application.
Registry has raised the following objections:
Clarification of Maintablity of Misc application and in prayer column, you have not mentioned about delay.
Thereafter matter was placed on objections board for removal of the objections on 03.10.2025, 16.10.2025, 13.11.2025, 04.12.2025, 16.12.2025 and 02.01.2026.
Applicant was given last chance to remove the objections On 13.11.2025, 04.12.2025 and 16.12.2025, however, till date objections have not been removed, despite of discussion held by applicant with DRT officials on the objections raised by the registry. Instead of removal of the objections, applicant sent the mail and letter for removal of the objections and requesting for hearing before the Hon’ble P.O.
Since, the applicant has not removed the objections and also did not clarified for filing of Misc application against the order of Ld. Recovery officer. Misc. Application in not appropriate application under the Recovery of Debts and Bankruptcy Act, 1993 against the impugned order passed by the Recovery Officer. Moreover Misc.
application vide dairy No. 699/2025 (MA) filed by the applicant is not within the preview of under section 22(2)
of RDDB Act, 1993.
In view of this, Dairy No. 699/2025 (MA) is required to be declined for registration.
The Registrar is empowered to decline the registration of the matter by following Section 5(4) of the DRT
(Procedure) Rules, 1993.
