Appeal/24/2007

Present :

Ms. Juhi Chavda, Ld. Counsel for the Appellant.

Mr. V.N. Sevak, Ld. Counsel for the Respondent Bank.

Ld. Counsel for the Appellant has submitted that she will file her Memo of Appearance during the course of this day.

Both the Ld. Counsels are in conformity that this matter pertains to financial dispute between two banks with regard to which the SARFAESI Act has very clear provision under Section-11 that such dispute may be decided through arbitration and hence this Tribunal has no role in this regard.

With this observation, this Appeal is being disposed of with liberty to both the parties to move before the right forum i.e. arbitration to settle their dispute.

Interim relief, if any, stands vacated hereby.

Let this file be consigned to records.

(PANKAJ KUMAR UPADHYAY) PRESIDING OFFICER, DRT-II, AHMEDABAD.
