**IN THE DEBTS RECOVERY TRIBUNAL-II AT AHMEDABAD**
**Present: Pankaj Kumar Upadhyay, Presiding Officer**
**CHAMBER APPEAL NO.: 1 of 2026**
**In**
**DIARY NO.2578 of 2025**
***Date of Order: 18/08/2026***
ICICI Bank Ltd.
..... Appellant
**Versus**
Neel Trading Co. & Ors.
.....Respondents
**Present:** Mr. Viral Khalas, Ld. Proxy Counsel for the Appellant
**ORDER**
1. 1. The Appellant has filed the present Chamber Appeal against the order dated 02/07/2026 passed by Ld. Registrar declining registration of the proposed OA on account of failure of the Appellant to remove the objections raised by the registry at the time of lodging of OA.
2. 2. I have heard Ld. Counsel for the Appellant and perused the record.
3. 3. It appears that the Ld. Registrar had raised objections to the following effect:
1. a. Serial Numbers of Defendants are not proper.
2. b. Only four Defendants are there and additional addresses are required to be mentioned.

4. It further appears from the record, the Registry had placed the matter on objection board on 16/02/2026, 06/03/2026, 25/03/2026, 13/04/2026, 30/04/2026, 18/05/2026, 02/06/2026 and 16/06/2026 for removal of objections. However, the Appellant failed to remove the aforesaid objections despite several opportunities afforded to it. Consequently, Ld. Registrar was constrained to pass impugned order dated 02/07/2026 declining registration of the proposed OA.
5. The Appellant has filed Draft Amendment at Page 9-12 along with the Memo of present Chamber Appeal. It appears from the said Draft Amendment that the Appellant has sought amendment in the cause title of OA by showing only four Defendants along with different addresses of the respective Defendants. Looking to the fact that the objections raised by the Registry are hyper-technical and defect can be set right by necessary amendment after registration of OA in the office of this Tribunal, the Appellant deserves to be given an opportunity to rectify the defect in the cause title of the OA in the interest of justice. However, the Appellant should be directed to pay cost of Rs.2,000/- for delay in removal of objections despite several opportunities. Therefore, the following order is being passed:
ORDER
- • The present Chamber Appeal is allowed.
- • The order dated 02/07/2026 passed by Ld. Registrar is hereby set aside.
- • The Registry is directed to register and number the proposed OA.
- • The Appellant is directed to take necessary steps for amendment in the cause title of the OA after its registration.
- • The Appellant is directed to deposit cost of Rs.2,000/- (Rupees Two Thousand only) with The Gujarat DRT Advocate Association, Ahmedabad, within a period of two days from today and to file a copy of acknowledgement of cost on the record of this Tribunal.
- • Let this file be consigned to record.
