NDN/1715/2026 Sakinaben Saifudin Makati(RA) v/s CENTRAL BANK OF INDIA 09.09.2026 The present matter concerns Review Application Diary No. 1715/2026, filed by the Applicant, who is a Guarantor in the present proceedings. It is submitted from the record that the Applicant has sought, inter alia, to set aside the judgment dated 23.05.2025 passed in the Original Application no. OA/159/2021. The principal ground raised by the Applicant is that Defendant No. 9 is the Applicant in the present proceedings, whereas the documents relied upon in the matter have been executed by Defendant No. 3 under a Power of Attorney on behalf of Defendant No. 9. It is contended that there is no document directly executed by Defendant No. 9. It is further contended that the said Power of Attorney was in the possession of the Bank and that the Power of Attorney contains the current address of Defendant No. 9, where she resides. Upon perusal of the record, it is further noticed that the Applicant has already filed Miscellaneous Application No. 1714/2026 raising the aforesaid grounds and seeking relief in respect of the judgment dated 23.05.2025 passed in the Original Application NO.159/2021. Thus, the Applicant has filed Miscellaneous Application No. 1714/2026 as well as the present Review Application Diary No. 1715/2026, substantially on the same grounds and in respect of the same judgment and subject matter. In the interest of proper administration of justice and to avoid simultaneous proceedings on the same grounds, it would not be appropriate to permit two separate applications filed by the same Applicant on the same cause and grounds to proceed independently. Only one proceeding on the same grounds and in respect of the same subject matter ought to survive for consideration.

Accordingly, Review Application Diary No. 1715/2026 is declined to be registered, as the Applicant has already filed Miscellaneous Application No. 1714/2026 on the same grounds in respect of the same judgment dated 23.05.2025. Registry is directed to verify the Miscellaneous Application No. 1714/2026 and place the matter for registration.
