IN THE DEBTS RECOVERY TRIBUNAL-II AT AHMEDABAD (Pankaj Kumar Upadhyay, Presiding Officer)

MA/47/2024

Gopaldas Madhusudan Patel & Ors. (prop. of M/s M.M.Patel) Vs. State Bank of India

31.01.2025

Present: Mr.Harjot Singh Kassowal, Ld. Counsel for the Applicants. (through virtual mode)

Mr.Dhruvkumar Chauhan, Ld. Counsel for the Respondent Bank.

Heard and perused.

Ld. Counsel for the Applicants submitted that *the present MA has been filed by Applicants before this Tribunal seeking condonation of delay of 112 days in filing Securitisation Application* against the actions taken by the Respondent Bank.

Since the Applicants herein have fully paid the outstanding dues of the Respondent Bank, *as claimed in OA No.465/2024*, and Respondent Bank has issued *'No Due Certificate' dated 29.01.2025*, no cause of action survives in favour of the present Applicants to file Securitisation Application. Therefore, the present Miscellaneous Application filed by the Applicants for condonation of delay has become infructuous and may be disposed of accordingly.

In view of the fact that no cause of action to file Securitisation Application in favour of the Applicants against Respondent Bank survives, the present Miscellaneous Application filed by the Applicants for condonation of delay is hereby disposed of with no order as to cost.

File be consigned to records.
