The Applicants have filed S.A.(Diary) No.2216 of 2023 along with Application for Condonation of Delay against the Respondent before this Tribunal and thereby, challenging the actions initiated by Respondent under the SARFAESI Act, 2002 against the Applicants of the Securitisation Application including Section 14 order passed by Ld DM Kheda-Nadiad dated 11.10.2023.
The Applicants further submitted that during the pendency of the above referred M.A.No.9 of 2024 Respondent has issued notice of sale dated 07.12.2024 for e-auction scheduled on 26.12.2024 and therefore, Applicants intend to withdraw the present Misc. Application No.9 of 2024.
In view of the above submissions of Ld. Counsel for the Applicant and contents of *Withdrawal Affidavit Ex.A/05*, the above M.A. deserves to be disposed-of and dismissed, with no order as to cost.
Order accordingly.
