1. 1. Today, this matter is listed for orders on Misc. Application No. 52 of 2024, filed by the Applicant-Borrower in S.A. No. 379 of 2019, with a prayer stating that although the final judgment in the said S.A. was passed on 14.10.2024, the Respondent Bank has not complied with the directions issued therein. Accordingly, through this Misc. Application, the Applicant has sought initiation of contempt proceedings against the Respondent Bank and has prayed for a direction to the Bank to restore possession to the Applicant.

2. 2. Today, the learned counsel for the Respondent Bank has filed a purshis Ex.R/10, along with a copy of the order dated 14.02.2025 passed by the Hon'ble DRAT, Mumbai in Appeal No. 9 of 2025. By the said order, the Hon'ble DRAT, Mumbai, has directed that the impugned order to the extent of restoring possession of the property under Section 17(3) of the SARFAESI Act, shall stand stayed till the disposal of the above mentioned Appeal. Let this purshis (Ex.R/10) be taken on record.

3. 3. In view of the order passed by the Hon'ble DRAT, Mumbai, the present Misc. Application No. 52 of 2024 has become infructuous, as the directions which the Applicant in the MA

wanted to comply by the Respondent Bank have been stayed by the Hon'ble DRAT, Mumbai.

Accordingly, Misc. Application No. 52 of 2024 is hereby disposed of as infructuous.

Let the file be consigned to the record.
