Mara Fashion and Ors vs ORIX LEASING FINANCIAL SERVICES INDIA LIMITED on 22 July 2025

Exh-08

22-07-2025

MA/51/2025

Present :

Mr. M.R. Pandey, Ld. Counsel for the Applicant.

Mr. Vishal Shukla, Ld. Proxy Counsel for the Respondent.

This MA has been filed for amendment in the order passed by this Tribunal in SA No: 320/2025 on 21-05-2025 while disposing this SA finally. When the question relating to maintainability of this MA was raised to the Ld. Counsel for the Applicant, after arguing for a few minutes, he submitted that he wants to withdraw this MA because he wants to file a fresh SA, for that permission may be granted and meanwhile the Respondent may be restrained to proceed with SARFAESI action.

While the Applicant is hereby being permitted to withdraw this MA, this Tribunal is not of the view that any permission for filing fresh SA is required from this Tribunal and as far as interim relief is concerned, when this MA itself is not maintainable, the question of interim order does not arise. Accordingly, this prayer is also rejected.

Accordingly, let this file be consigned to records.
