Ms Priyankshi Fashions Pvt Ltd And Ors vs THE SOUTH INDIAN BANK LTD on 23 July 2025

Exh-12

23-07-2025

MA/5/2025

Present :

None appeared on behalf of the Applicant.

Mr. G.D. Sharma , Ld. Counsel for the Respondent Bank.

The Ld. Counsel for the Respondent has filed Purshish Exh.R/11 with a request to reject the present MA and interlocutory application on the ground of non-maintainability of this MA. On this Purshish, there is an endorsement by the previous Counsel of the Applicant Ms. Juhi Chavda with effect **"No objection no instruction from the Applicant"**.

This MA was filed for extension of time to deposit certain amount which was scheduled in SA No: 240/2024 and which was finally disposed of by this Tribunal vide order dated 07-10-2024.

There is a latest trend in this Tribunal for filing such type of MAs which are not supported by any procedure of any law applicable in this Tribunal. An order by which any SA or OA is finally disposed cannot be scrutinised or discussed by filing an MA because entertaining such type of MA will amount, reviewing by this Tribunal of its own judgement/order, which is not permissible.

Accordingly, this MA being non maintainable as per law is hereby rejected.

Let this file be consigned to records.

(PANKAJ KUMAR UPADHYAY) PRESIDING OFFICER, DRT-II, AHMEDABAD.
