Ld. Counsel for the Applicant has filed *pursis Ex.A/14* stating therein that Applicant has filed present Miscellaneous Application along with Appeal challenging the order passed by the Ld. Recovery Officer vide order dated 02.02.2024. He further submitted that the CH Bank intend to move an appropriate application before the Ld. Recovery Officer and therefore the CH Bank do not press the present Miscellaneous Application as well as the consequential Appeal, which is yet to be numbered and pending before this Tribunal and also requested to pass appropriate order.

In view of the above situation and without commenting on the merits of the case and at the request of Ld. Counsel for the Applicant, the present Miscellaneous Application stands disposed of being not pressed by the Applicant, with no order as to cost.

Order accordingly.
