Sheikh, Ld. Counsel for appellant

Ld. Counsel for appellant has submitted that against the proposed SA filed by the appellant, Id. Registrar has passed order dated 06.08.2025 declining to register the Securitization Application on the ground that in spite of being given time on 23.06.2025, 08.07.2025 and 21.07.2025 to remove the objection dated 02.03.2025, the appellant has not removed those objections.

Ld. Counsel for the appellant submits and undertakes that one more opportunity may be given to remove the objection and file necessary documents which are necessary to be filed with this SA.

There is no doubt that the delay on the part of the appellant is not justifiable, however, the appellant needs to be given one more opportunity to remove the objections, because, the objective of justice lies in disposal of various applications on merits and not in denial on technical grounds.

In the views of this Tribunal, this CA deserves to be disposed of at the admission stage with permission to the appellant to remove the objection as raised by the Id. Registrar at the stage of registration of this SA within seven days from today.

With these observations, this CA is finally disposed of.

(PANKAJ KUMAR UPADHYAY)
PRESIDING OFFICER
DRT-II, AHMEDABAD
