Today this matter has come up for hearing for consideration on withdrawal affidavit filed by the Applicants.
Ld. Counsel for the Applicants has filed a withdrawal affidavit at Exh.A/08 duly sworn by Mr.Shaileshbhai Hanshrajbhai Talpada, Applicant no.2 for himself and on behalf of other Applicants, submitting interalia that during the pendency of the present Application, the Applicants have handover the possession of the secured assets to the Respondent/Financial Institution and accordingly, the Respondent/Financial Institution has sold the properties in question. In view of the above, it is submitted that the Applicants does not want to proceed further in the matter.
It is further submitted that in view of the aforesaid facts, the Applicants want to withdraw the present Review Application filed against the Respondent /Financial Institution.
Per contra, Ld. Counsel for the Respondent /Financial Institution submitted that in view of the submissions made by the Ld. Counsel for the Applicants, he has no objections, if the Review Application may be disposed of as per the withdrawal affidavit filed by the Applicants.
I have carefully examined the withdrawal affidavit at Exh.A/08 filed by the Applicants and considering the fact that Applicants want to withdraw the Review Application, the present Review Application is dismissed as withdrawn.
Let the file be consigned to records.
