ORDER

(Passed on 26th February, 2026)

1. 1. That this M.A. has been brought by the Applicant for the order dated 12.08.16 excluded by returning the amount so deposited by the Auction Purchaser (Present Applicant) along with compound interest.

2. 2. Facts in brief are in dispute. The applicant participates in the auction scheduled by Respondent no. 1 on 22.09.2015 and declared successful bidder. It is stated that he paid the entire amount of Rs. 60, 25,000/- and the said and the sale certificate 2MA 09/23

was issued in his name. Subsequently, the SA no. 175/13 was allowed and direction must be there for return of the amount. It is submitted that despite several reminders the amount was not returned back to him.

3. The Learned Counsel for the Respondent Bank submits that the respondent bank could not travel during order of the tribunal passed in judgment dated 12.04.2014. It is stated that in relief D the bank was direct to return the full amount to the auction purchaser. It is submitted that instead of claiming the principal amount the applicant is claiming for amount interest @ 18% which has not been adjudicated and directed by this Tribunal. In view of the fact I find that the judgment is explicit and the Respondent bank has been directed to return the principal amount only accordingly the Respondent bank is directed to comply the order. The M.A. is disposed accordingly.
