c$ruro. oRDER.SHEET DATE PAGE No CASE No REMARK MA82lt6 t4l05lt9 DESCRIPTION OF THE ORDER Shri.Ashish Ganguly, Adv. for the applicant. Shri.R.N.Roy, Adv. for Res.No.1. None for remaining respondents. The present MA has been filed by the applicant on 0-09-16 praying for setting aside the exparte Judgment td.01-09-16 (Annex.A-l) passed in OA236/14. The main contention of the Counsel for the plicant is that the applicant did not receive any notice fOA filed by respondent bank before DRT, Jabalpur. Duly considered submissions. It is seen that otices were duly sent by registered post to defendant applicant herein) and thereafter paper publication was o made in newspaper. The applicant has simply tated that he did not receive any notice from this rlbunal. The notice of the OA was sent on the same ddress on which copy of Judgment was sent and the address has been mentioned in the present MA lso. Thus, when the copy of Judgment was received on e same address, there is no reason to disbelieve that e applicant was not served properly. In the event, the present MA stands dismissed eing devoid of merits and substance. Record be consigned to record room. (B K. Sinha) Pr iding Officer
