ORDER

The applicant was discharged on completion of tenure on 31.10.2024. He was in a permanent low medical category on account of disability of ‘Inflamamatory- Spondylopathy, Unspecified’, the extent of which was assessed to be 20% for life but neither attributable to nor aggravated by military service. Thus, claim for grant of disability element was rejected. Learned counsel for the applicant relies upon Categorization Medical Board dated 13.03.2021 (Annexure A-2), to submit that the said Board had assessed the disability to have been aggravated by military service. The Release Medical Board (RMB) was not justified in assessing the disability without taking into consideration the earlier finding. Notice.

Mr. Jagjot Singh Lalli, Deputy Solicitor General of India accepts notice on behalf of respondents and waives service and seeks time to file reply. Adjourned to 02.04.2027.
