ORDER

The applicant was discharged on 31.07.2025. He was in a Permanent Low Medical Category on account of disability of Seizure Disorder. No sheltered appointment was available for him. He has been granted service element but claim for grant of disability element has been rejected because the disability has been assessed to be neither attributable to nor aggravated by military service and the extent thereof is 5% for life.

Learned counsel for the applicant has submitted that Categorization Medical Boards dated 17.08.2015 (Annexure A-2) and dated 25.07.2016 (Annexure A-3) have assessed the disability to have been aggravated by military service. The Release Medical Board (RMB) was not justified in assessing the same differently without considering the earlier finding. She also submits that perusal of Categorization Medical Board dated 27.04.2023 (Annexure A-6) shows that the extent of disability was found to be 20%. Thus, the finding also could not have been changed by the RMB without considering the same.
