ORDER

The applicant was discharged on completion of terms of engagement on 31.08.2017. He was in a Permanent Low Medical Category on account of disability of Panic Disorder, the extent of which was assessed to be 40% for life but neither attributable to nor aggravated by military service. Thus, claim for grant of disability element has been rejected.

Learned counsel for the applicant relies upon Rule 7 of the Entitlement Rules for Casualty Pensionary Awards to Armed Forces Personnel, 2008 (hereinafter referred to as the Rules) to submit that the applicant is not required to establish conditions for grant of claim. It is for the respondents to show that he is not entitled. Reasons given by the Release Medical Board are not sufficient to fulfil the requirements laid down by Rule 7 of the Rules.

Notice. JS Lalli, DSGI, accepts notice on behalf of the respondents and waives service and seeks time to file reply.

Adjourned to 01.04.2027.
