ORDER

The applicant was discharged on 31.08.2024 because he was in a Permanent Low Medical Category and no sheltered appointment was available for him. His medical category had been permanently downgraded on account of disability of PIVD L4-L5, the extent of which has been assessed to be 6% for life but neither attributable to nor aggravated by military service. Thus, claim for grant of disability element has been rejected.

Learned counsel for the applicant relies upon Categorization Medical Boards dated 26.12.2022 and dated 25.07.2023 (collectively annexed as Annexure A-2) to submit that the earlier Board had assessed the disability to have been aggravated by military service, whereas the later Board assessed the extent to be 30%. The Release Medical Board was not justified in reversing these findings without considering the same. Notice. JS Lalli, DSGI, accepts notice on behalf of the respondents and waives service and seeks time to file reply.

Adjourned to 01.04.2027.
